Terms and conditions

1. Scope and seller

These terms apply to contracts concluded by consumers through the Ferrum Culina online store. The seller is Ferrum Culina, owner Fynn Hackbusch, Krummholzstraße 17a, 79206 Breisach am Rhein, Germany, phone +49 1573 0487583, email ferrumculina@gmail.com. A consumer is any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Formation of the contract

The presentation of goods in the online store does not constitute a legally binding offer, but an invitation to place an order. Customers can select goods and variants, place them in the cart and review or correct their entries before completing the order. By activating the final order or payment button, the customer submits a binding offer to purchase. An automatically generated receipt confirmation initially only records receipt of the order unless it expressly states acceptance. The contract is concluded when we expressly accept the order, send the shipping confirmation or dispatch the goods. For payment methods that trigger payment immediately, the supplementary terms of the relevant payment provider remain unaffected.

3. Contract language and storage

The contract language is German. An English store version is also provided. Order and contract data is stored in accordance with statutory and technical requirements. Customers can also access available order information through their Shopify customer account. The store is technically operated using Shopify. Information on Shopify's processing, including the currently enabled Shopify Network Intelligence, is set out in our privacy policy.

4. Prices and German small-business VAT exemption

All prices shown in the store are final prices in euros. Ferrum Culina applies the German small-business VAT exemption under section 19 UStG; VAT is therefore not shown separately. Premium standard shipping within Germany is currently free of charge.

5. Payment methods

The payment methods actually available are displayed in checkout before the order is completed. These may include Shop Pay, Visa, Mastercard, American Express, Maestro, UnionPay, Apple Pay, Google Pay, PayPal, Klarna and other local methods made available through Shopify Payments. There is no entitlement to the permanent availability of a particular payment method. Payments may be processed by Shopify and/or the payment provider selected by the customer. The relevant provider's terms may apply in addition.

6. Delivery area, shipping and delivery time

Ferrum Culina currently delivers only to delivery addresses in Germany. Orders are handled through external fulfilment and logistics partners and may be shipped directly from China. The estimated delivery time is approx. 5–8 business days. This is an estimated delivery time and not a guaranteed delivery deadline. Tracking is included. Premium standard shipping for currently offered orders to Germany is free of charge.

7. Customs and import charges

Customers should not incur additional customs or import charges on proper delivery. If additional import charges are nevertheless requested in connection with a delivery properly arranged by Ferrum Culina, please contact ferrumculina@gmail.com before paying the carrier. Any such charges that Ferrum Culina is responsible for and that the customer demonstrably had to pay will be reimbursed.

8. Partial deliveries and passing of risk

Where reasonable for the customer, goods in one order may be delivered in more than one shipment for logistical reasons. Ferrum Culina does not charge additional shipping fees for this. For consumers, the risk of accidental loss or deterioration generally passes only when the goods are handed over to the consumer or a person designated by them to receive the goods, unless the law provides otherwise.

9. Retention of title

The delivered goods remain the property of Ferrum Culina until payment has been made in full.

10. Statutory conformity and defect rights

Statutory rights relating to defective or non-conforming goods apply. If the goods are defective, customers are entitled to the remedies provided by law. Necessary costs of statutory remedy are borne by Ferrum Culina as required by law. These terms do not restrict statutory rights to remedy, termination, price reduction, damages or other mandatory consumer rights.

11. Voluntary guarantees

An additional voluntary guarantee exists only where it is expressly described as a guarantee for the relevant product and the corresponding guarantee terms are provided. General product descriptions or advertising claims do not create a separate guarantee unless expressly stated as such.

12. Right of withdrawal

Consumers have the statutory right of withdrawal. Details are set out in our separate withdrawal information and returns/refunds policy. The store also provides the electronic “Withdraw contract” function.

13. Shipping Security

Customers may optionally select the “Shipping Security” add-on for €5.00. It can be added at most once per order. Shipping Security is a voluntary add-on for priority review and handling of reported shipping damage or parcel loss. When reporting an issue, customers should provide their order number and, where visible damage exists, suitable photos where possible. Shipping Security is not insurance. Purchasing it is not a condition for exercising statutory rights; statutory warranty, reimbursement, remedy, damages and other consumer rights remain fully unaffected. If the entire order is validly withdrawn, the Shipping Security price is also refunded.

14. Product presentation and information

We aim to present products accurately. Colours and surfaces may vary slightly depending on the screen and device. The specific product description, selected variant and information displayed at the time of purchase are decisive. Unconfirmed claims regarding alloy grades, certifications, temperature suitability, dishwasher suitability, weight or material thickness are not warranted.

15. Liability

Ferrum Culina's liability is unlimited in cases of intent or gross negligence, injury to life, body or health, and wherever liability is mandatory by law. In the event of a slightly negligent breach of essential contractual obligations, liability is limited, where legally permissible, to foreseeable loss typical for the contract. Essential obligations are those whose fulfilment is necessary for proper performance of the contract and on which the customer may normally rely. Mandatory claims, including product liability claims, remain unaffected.

16. Consumer dispute resolution

Ferrum Culina is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body. Any statutory information duties arising after a specific dispute remain unaffected.

17. Applicable law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country in which they have their habitual residence.

18. Final provisions

If individual provisions of these terms are or become invalid, the remaining statutory and contractual provisions remain unaffected.
